Mac, I voted you a 4 for being on the ball
1) I said we theoretically had free speech and I said that the idea of being arrested for speaking horrified me.
The Patriot Act (the most poorly titled document in history - "A Modest Proposal" having been written ironically as it was satire (eating babies!!) - is a crime in and of itself and I don't recognize anything it says. I'm going strictly on year 2000 law, and more specifically, going only on the rights guaranteed by the Constitution. So, yeah, I could be arrested by saying certain things on the phone or in public, but I don't think it should be that way.
2) Threats - if you were to tell someone you intended to hurt them, or for instance, comment on how you were going to come to school tomorrow and kill a bunch of random people, yeah you can and should get arrested for that, because you might be serious. But saying in a general sense "I wish group X would die or go home or that I could kill them" or "I wanna eat babies" isn't the same, if you're not indicating you might actually do something.
3) Hate Crime - I'm no lawyer, so I'm not clear, but I only ever hear about Hate Crime when another crime has already been committed. I don't like Hate Crime law because it diminished crimes of passion and those that were committed for personal gain or no reason at all. As if those victims were worth less because they weren't a minority.
However, I would support a law against trying to terrorize or marginalize a group of people through otherwize legal action (i.e. that couldn't be prosecuted on its own merits), but not to the point that someone could be arrested for spewing their bile in a parade or on a talk show or in a common area, assuming they weren't swarming the place, or cornering or harrassing people.
My sister did some small-scale protesting when she was a teen, and it got her noticed by authorities. They questioned her on the site and took some information. I don't like that they were interested in her, but I'm okay with someone coming and talking to her. But if she were arrested for talking -
